1. Definitions

• "GoldBand Collective" — the membership-based mining investment platform operating at goldbandcollective.com.
• "Member" — an individual whose application has been approved and who has been assigned to a mining plant tier.
• "Plant" — a physical mining operation in Zimbabwe to which a member is allocated.
• "Returns" — the monthly or biweekly payouts issued to members based on their plan tier and plant output.
• "Admin" — the GoldBand Collective management team responsible for operations, approvals, and payouts.

2. Membership & Approval

Membership is by application only. Submission of an application does not guarantee approval. Admin reserves the right to approve or reject any application at its sole discretion, without obligation to provide reasons.

Applicants must be at least 18 years of age and provide accurate, complete information. Providing false or misleading information may result in immediate termination of membership and forfeiture of any pending returns.

Membership is non-transferable. A member may not sell, assign, or transfer their membership, plan tier, or plant allocation to another person.

3. Investment Plans & Returns

GoldBand Collective offers three investment tiers: Small (R5,000), Medium (R10,000), and Large (R20,000). Each tier corresponds to a specific mining plant allocation.

Returns are calculated at 10% per month of the investment amount. Actual payout amounts are fixed per plan tier:

• Small Plan: R500 per month
• Medium Plan: R1,000 per month
• Large Plan: R2,000 per month

Returns are distributed on a biweekly or monthly schedule as determined by Admin. Payouts are contingent on the continued operation of the member's assigned plant.

4. Plant Operations & Payout Continuity

Returns are directly tied to the operational status of the member's assigned mining plant. GoldBand Collective guarantees returns only for as long as the plant remains operational.

If a plant enters maintenance, pauses operations, or ceases production for any reason, payouts to members assigned to that plant will be paused. Payouts resume when the plant returns to operation. No retroactive payments will be issued for downtime periods.

Admin will make reasonable efforts to notify members of any plant status changes via the member dashboard and messaging system.

5. No Guarantees or Speculation

GoldBand Collective is not a financial institution, investment fund, or trading platform. Membership represents direct participation in physical mining output, not a financial product.

While we strive for consistent plant operation, mining is subject to operational, regulatory, and environmental factors beyond our control. Members acknowledge that returns are not guaranteed and that capital invested is at risk.

GoldBand Collective does not offer fixed-term contracts, guaranteed buybacks, or insured returns. Members participate on a perpetual, at-will basis tied to plant performance.

6. Payout Processing

Payouts are processed via EFT or mobile money transfer to the banking details provided by the member during onboarding. Members are responsible for ensuring their payout details are accurate and up to date.

GoldBand Collective is not responsible for delays caused by incorrect banking information, intermediary bank processing times, or third-party payment providers.

Any transaction fees associated with payouts are the responsibility of the member unless otherwise stated by Admin.

7. Member Conduct

Members agree to:

• Use the member dashboard and messaging system responsibly and respectfully.
• Not share login credentials or grant access to their account to any third party.
• Not use the platform for any unlawful purpose or in violation of any applicable laws.
• Not harass, abuse, or make unreasonable demands of Admin or other members.

Admin reserves the right to suspend or terminate membership for any conduct deemed detrimental to the collective or its operations.

8. Termination of Membership

Either party may terminate the membership relationship at any time. To terminate, a member must notify Admin in writing via email or the dashboard messaging system.

Upon termination:

• The member's access to the dashboard and messaging system will be revoked.
• Any pending payouts for completed cycles will be processed.
• No refund of the initial investment amount is provided. The investment is allocated to plant operations and is not held as a deposit.

Admin may terminate membership immediately if a member breaches these terms, provides false information, or engages in conduct harmful to the collective.

9. Intellectual Property

All content on this website — including text, images, logos, plant photos, videos, and design elements — is the property of GoldBand Collective. Members may not reproduce, distribute, or use any content without prior written permission from Admin.

Plant photos and videos provided on member dashboards are for personal viewing only and may not be shared publicly or used for any commercial purpose.

10. Limitation of Liability

To the fullest extent permitted by law, GoldBand Collective and its administrators shall not be liable for any direct, indirect, incidental, or consequential losses arising from:

• Plant downtime or cessation of operations.
• Delays or failures in payout processing caused by third-party providers.
• Unauthorised access to a member's account due to the member's negligence.
• Changes in regulatory or legal environments affecting mining operations.

Members participate at their own risk and acknowledge the inherent uncertainties of mining investment.

11. Changes to These Terms

GoldBand Collective may update these Terms and Conditions at any time. Members will be notified of material changes via the dashboard or email. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
